PRIVACY POLICY

Superior Mobile Medics, Inc. (“Superior”) is the sole owner and operator of the following three primary domain names: superiormobilemedics.com smminsurance.com smmhealth.com superiorexams.com, supermedics.com, and supermm.com are legacy domain names that redirect to one of the three primary domain names above.

Collectively, these sites are all referred to as Superior’s “Websites.” Superior is an incorporated business, governed by the laws of the State of California, in the County and City of San Diego. This Privacy Policy (“Policy”) covers Superior’s Websites, including any sub-domains and subordinate sites. In addition, there are back-end databases and file storage systems that store data collected through Superior’s websites; for purposes of this Policy, those databases and file storage systems shall be considered part of Superior’s Website. Lastly, Superior operates other systems and services that may also gather information that is then stored in Superior’s Websites, and shall be considered by this Policy a part thereof. This Policy discloses Superior’s privacy practices in order to demonstrate Superior’s commitment to privacy. Specifically included are:

  1. What information the Website collects.
  2. How Superior and its Websites use the information.
  3. With whom Superior may share user information.
  4. What choices are available to users regarding the collection, use, and deletion of the information.
  5. What types of security procedures are in place to protect information collected on—and stored by—the Websites.
  6. How users and their clients can obtain, amend, or delete their personal information.

This Policy is effective as of the earlier of effective date above, or the date it is posted online.

INFORMATION COLLECTION AND USE:

Information Collection and Ownership
Superior collects information from authorized users of its Websites. That information—and other information Superior creates on behalf of its customers—remains the property of Superior, unless Superior’s agreements with those customers state otherwise. In some cases, ownership may be shared or split depending on the nature and scope of the information.

Client information
Superior collects data, including data that may qualify as Personally Identifiable Information (PII) or Protected Health Information (PHI), including client name, social security number, age, date of birth, medical exam information, and other data possibly identifying existing health conditions. Superior also creates some of this data as part of its performance of services for its customers. This information is kept secure and is only available to authorized users within—and outside— of the organization. An authorized login is required to access any such data. This information is only transmitted in an encrypted state, although the information may be stored unencrypted on servers within Superior’s secured network. To minimize the amount and depth of data collected and maintained, Superior will generally collect and maintain the least amount of information necessary to complete its service delivery to its customers. However, customer requirements ultimately dictate the scope of data collected. Client information may be provided to authorized ordering parties (including insurance agencies, agents, insurance underwriters, and health & wellness partners/customers) where it may be used in determining an individual's insurability and/or for assisting in the application and underwriting process, evaluation of a client’s health as part of a wellness program, and for other legally permissible activities. Any individual about whom Superior retain any information may contact the ordering party who provided us the information, or may contact Superior’s compliance department for more information about the safeguards used.

Cookies
A cookie is a piece of data stored on the user’s computer tied to information about the user. Superior’s Websites only use cookies to store session IDs for authentication purposes. Cookies do not store actual authentication information, and are not linked to any personally identifiable information while on the Website. Superior does not use persistent cookies (small text files stored on the user’s hard drive for an extended period of time). This privacy statement covers the use of cookies by Superior only and does not cover the use of cookies by any third parties or any of Superior’s partners, all of whom may have their own privacy policies that may differ from Superior’s.

Log Files
Like most standard Web site servers, access log files are generated each time a visitor accesses a Superior website. This includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. This information does not contain any personally identifiable information, nor is it linked to such information.

REGULATORY COMPLIANCE:

Superior maintains information that may be classified as Protected Health Information (PHI), and Personally Identifiable Information (PII) as defined by the Office of Management and Budget. Superior ensures compliance with all applicable federal and state laws and regulations, all as they may be amended from time to time, by enacting responsible policies and procedures that will allow it to fulfill that mission now and in the future.

SHARING OF INFORMATION

Disclosures Required By Law
Though every effort is made to preserve user privacy, it is occasionally necessary to disclose personal information when required by law wherein the site and interested parties have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order, or legal process served on the Web site.

Instances in which users’ personal information may be shared
Information is never shared or made available to any third parties, except as follows:

  • Where required by law
  • Personal information provided by users of Superior’s Website—and information Superior and its providers creates on their behalf—may be shared back with those users, and with Superior’s customers that compensate Superior for providing services. Once information is disclosed to those parties, Superior no longer has control over the information or how it is used, however Superior can provide individuals an accounting of where their information was shared so they may contact those respective parties regarding their own privacy policies.
  • As part of delivering its services, Superior may share personal information with its subcontractors, partners, or other trusted businesses or persons for the purpose of processing the information on Superior’s behalf. In such cases, those parties are contractually—and in many cases, legally—required to follow Superior’s instructions and operate consistent with this Policy and applicable law.
  • To enforce applicable Terms of Service, including investigation of potential violations thereof, to detect and prevent security or technical issues, and to protect against harm to the rights, property and safety of Superior, its customers, and the public as required or permitted by law.

Business Transitions
In the event Superior goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, all personal information that Superior possesses will likely be part of the assets transferred and Superior can neither warrant nor guarantee the safeguards used by any acquiring company.

This Web site may contain links to other sites. Superior is not responsible for the privacy practices of such other sites. Users should pay attention to the privacy practices whenever visiting other websites.

Security

Superior’s Websites use both Administrative and Technical safeguards to protect users and clients’ information. When personal information is input into the Website, information is protected both online and off-line. When users are asked to enter sensitive information (such as placing orders for medical examinations for clients), that information is encrypted and is protected using industry-accepted encryption technologies. Users are expected to remain vigilant to assure that their computers are safe and free of any viruses or malware. Superior makes no warranty about—and users hereby indemnify and hold harmless Superior for any losses resulting from a deficiency or failure in—the security of end users’ computers. While encryption is used to protect sensitive information online, Superior also uses appropriate safeguards to physically secure users’ information as well. Superior’s Websites operate in a secure environment, accessible to only select Superior staff, and are not accessible to the public.

Correcting Of/Deleting Personal Information

If a user needs to update client information, or if a user no longer desires services, product, or communication from Superior, that authorized user may update their information by following the "customer service" link provided on the website, or by sending an Email to cs@superiormobilemedics.com. Superior will respect an individual’s request to delete or not disclose their information wherever possible, however Superior cannot guarantee that information already disclosed can be retracted or recovered. Also, Superior may be required to maintain some basic information about an individual for accounting and billing purposes, as well we other tax or legal reasons. Notwithstanding any agreements or commitments to the contrary, users and their clients accept all risk and agree to indemnify and hold harmless Superior for any disclosures of their information made according to this Policy, including any disclosures made by any subcontractors or partners of Superior, except where such disclosure is the result of Superior’s gross negligence or willful misconduct in which case, Superior’s liability shall be limited to the amount of its commercial or cyber liability insurance as applicable.

Notification Of Changes

If changes are made to this Policy, such changes will be reflected in updated postings of this Policy, and possibly the Website’s homepage or other places deemed appropriate so users can always be aware of what information is collected, how it is used, and under what circumstances, if any, it is disclosed.
